Grand Jury Indicts 14 Heartless Felons Gang Members

11/5/2014 Cleveland – The Grand Jury has returned a 217-count indictment against 14 members of the Heartless Felons who will be tried as adults for their participation in gang-driven violence at the Cuyahoga County Juvenile Detention Center, Cuyahoga County Prosecutor Timothy J. McGinty announced today.

The 14 are among the 43 gang members included in a 437-count juvenile complaint that was filed in June for crimes committed in the Detention Center. The complaint’s charges included participation in a criminal gang, RICO, assault, kidnapping, robbery, extortion, aggravated rioting, vandalism, menacing and intimidation. Members of the Heartless Felons directed their violence and intimidation toward others being held at the Detention Center and toward staff members. They orchestrated beatings and robberies and often extorted food and medications from their victims.

It was the largest juvenile gang case ever filed in the state of Ohio.

The defendants named in today’s indictment were bound over by the Cuyahoga County Juvenile Court to be tried as adults in Common Pleas Court. Of the remaining defendants, 26 have entered guilty pleas in Juvenile Court and two are awaiting trial in Juvenile Court. One additional defendant is still in the jurisdiction of the Juvenile Court pending the outcome of a competency evaluation.

All 14 defendants charged by the Grand Jury face one count of Participating in a Criminal Gang, a second-degree felony, and one count of Engaging in a Pattern of Corrupt Activity (commonly known as RICO), a first-degree felony. If convicted of these two counts, the defendants could face a prison sentence of five to 19 years.

“The young men who face these charges represent the most hostile and brazen offenders in the detention center. The intimidation and violence committed by Heartless Felons created a dangerous environment and undermined any chance of rehabilitation for their fellow residents,” said First Assistant County Prosecutor Duane Deskins, who also heads the office’s Juvenile Division. “To be a Heartless Felon is to commit to a life of crime, and for their adult offenses, these defendants will have to face adult consequences.”
