Kristin Sobieski, Appeals Unit Supervisor



Mary McGrath, Assistant Supervisor, Appeals Unit

Mary McGrath received her J.D. from the Cleveland-Marshall College of Law and is a graduate of the University of Dayton. She is responsible for all areas of criminal law and represents the State of Ohio before all courts and before the Ohio Parole Board. She joined the Prosecutor’s Office in 1996 and has worked in the General Felony Unit and Appeals Unit. She has tried more than 70 felony cases; participating in nine murder trials, four of which were capital cases, two of which resulted in death sentences. She has argued before the Eighth District Court in more than 250 cases and before the Ohio Supreme Court in several cases. And in 2015 won the John T. Corrigan Award for Exceptional Service, recognizing Mary’s exceptional tenacity, integrity and professionalism in the pursuit of justice.

James E. Moss, Senior Appellate Attorney

James (“Jim”) Moss joined the Cuyahoga County Prosecutor’s Office in 1998. He earned his J.D. from the Cleveland-Marshall College of Law in 1993 and his Masters Degree in Library Science in 1999. He is responsible for legal research for more than 200 Assistant Prosecuting Attorneys, supervises more than 20 law clerks, drafts search warrants, and creates and maintains indictment language in a case management database, among other responsibilities. He also represents the Cuyahoga County Court of Common Pleas and its 34 judges in responses to petitions for extraordinary writs before the Eighth District Court of Appeals and the Ohio Supreme Court. In 2014 Jim won the Cuyahoga County Prosecutor’s Unsung Hero Award, recognizing his initiative, perseverance and humility and that he sets an example of leadership without expectation of recognition.

Christopher Schroeder, Managing Attorney, Capital Case Docket

Chris is a 2012 graduate of the Cleveland Marshall College of Law, and before that, he was a 2009 graduate of John Carroll University. For the past two years, Chris has been a member of the Economic Crimes Unit where he prosecuted organized gambling, public corruption, and internal affairs cases involving the Cleveland Division of Police. Chris has argued cases in five different Ohio appellate courts and the Ohio Supreme Court. Before he became an Assistant Prosecutor in 2013, Chris worked for three years as a law clerk, including on the cases of Anthony Sowell and Denny Ross.

Daniel T. Van, Senior Appellate Attorney

Daniel (“Dan”) Van joined the Cuyahoga County Prosecutor’s Office after earning his joint J.D./M.B.A. degrees from Case Western Reserve University. He received a B.S. in Criminal Justice Administration and in Political Science from San Jose State University. He is responsible for litigating in criminal appellate and post-conviction matters in both the State and Federal court systems. He has handled numerous cases in both state and federal court and has argued eight cases before the Ohio Supreme Court, including State v. Brunning, 2012-Ohio-5752; In re M.W., 2012-Ohio-4538, and State v. Johnson, 2010-Ohio-6301. He is currently admitted to practice law in Ohio state courts, the United States District Court for the Northern District of Ohio, and the Sixth Circuit Court of Appeals. In 2015, Dan won the Pillar of Justice Award for Outstanding Performance in the Appeals Unit.

Maggie Dyczek, Assistant Prosecuting Attorney

Maggie (Mary) Dyczek joined the Cuyahoga County Prosecutor's Office in March 2016. Maggie received her J.D. from Cleveland-Marshall College of Law in 2011, graduating summa cum laude. She also earned her B.S.B.A. from Boston University in 2008, graduating magna cum laude. As an assistant prosecuting attorney in the Appeals Unit, Maggie is responsible for litigating post-conviction issues before the Cuyahoga County Court of Common Pleas, the Eighth District Court of Appeals, and the Ohio Supreme Court, drafting search warrants, and representing the State in parole matters. Prior to joining the Prosecutor's Office, she was an associate at a law firm in Cleveland representing public and private companies in government investigations and criminal and civil matters.

Diane Smilanick, Assistant Prosecuting Attorney

Diane Smilanick received her J.D. from the Cleveland- Marshall College of Law, after receiving her in B.A. in Political Science and Social Work, magna cum laude, from Cleveland State University. She has been an Assistant Prosecuting Attorney for more than 20 years. She is responsible for litigating post-conviction motions before the Cuyahoga County Court of Common Pleas and Eight District Court of Appeals. She further manages the Cuyahoga County Prosecutor’s Office’s responses to the Ohio Parole Board and offenders’ requests for expungement of criminal records.

Brett Hammond, Assistant Prosecuting Attorney

Brett Hammond joined the Cuyahoga County Prosecutor’s Office in October of 2013. He is responsible for litigating all criminal issues before the Cuyahoga County Common Pleas Court and the Eighth District Court of Appeals and has argued before the Ohio Supreme Court. He received his J.D. from Washington University in St. Louis in 2012, and he completed his undergraduate studies at Williams College in 2005. Prior to joining the Cuyahoga County Prosecutor’s Office, Brett was a fellow working with the Honorable Anna Blackburne-Rigsby from the District of Columbia Court of Appeals.

Anthony Miranda, Assistant Prosecuting Attorney

Anthony Miranda joined the Appeals Unit of the Cuyahoga County Prosecutor’s Office in 2014. He received a J.D. from Cleveland-Marshall College of Law and a B.S.E. from John Carroll University. Anthony is responsible for appellate and post-conviction criminal litigation, drafting search warrants, and responding to parole matters. He has successfully argued in the Supreme Court of Ohio and the Eighth District Court of Appeals.

Amy E. Venesile, Assistant Prosecuting Attorney

Amy E. Venesile, Assistant Prosecuting Attorney, rejoined the Cuyahoga County Prosecutor’s Office in December 2013, having served from 2001 to 2006. Amy received her J.D. from the Cleveland-Marshall College of Law. She is responsible for appellate and post-conviction criminal litigation and has argued before the Eighth District Court of Appeals. For six years, she served as a Judicial Staff Attorney for the Cuyahoga County Court of Common Pleas where she managed the court’s civil docket, drafted numerous judicial opinions and memoranda, conducted final pretrials, and mediated settlement negotiations with case parties. She also was Program Manager for The Honor Project Trust and was instrumental in establishing this non-profit organization, which served to disburse a large settlement fund resulting from antitrust litigation.

Frank R. Zeleznikar, Assistant Prosecuting Attorney

Assistant Prosecuting Attorney Frank Romeo Zeleznikar joined the Appellate Division of the Cuyahoga County Prosecutor’s Office in June, 2014. He earned his J.D., graduating magna cum laude, from Cleveland-Marshall College of Law, and also earned a B.A. from Cleveland State University, while majoring in Philosophy and Sociology. As an assistant prosecutor in the Appellate Division, Frank is responsible for litigating all post-conviction criminal issues before the Cuyahoga County Common Pleas Court and the Eighth District Court of Appeals. Prior to joining the Cuyahoga County Prosecutor’s Office, Frank was an Assistant Prosecuting Attorney for Erie County, where he worked in the Appellate and General Felony Divisions.

Greg Ochocki, Assistant Prosecuting Attorney

Greg Ochocki joined the Cuyahoga County Prosecutor’s Office in 2015. He received his J.D. from Cleveland-Marshall College of Law and his undergraduate degree from St. Bonaventure University. He is admitted to practice before Ohio state courts, the United States District Courts for the Northern and Southern Districts of Ohio, and the United States Court of Appeals for the Sixth Circuit.
